These Terms of Use ("Terms") constitute a legally binding agreement between you and Vadoo Internet Services Private Limited ("Company", "we", "us", or "our") governing your access to and use of the PhotoAI mobile application and related services ("App"). By downloading, installing, or using the App you confirm that you have read, understood, and agree to be bound by these Terms. If you do not agree, do not use the App.
These Terms also serve as the End User License Agreement (EULA) required by Apple Inc. for apps distributed through the App Store. Apple is not a party to this agreement and has no obligation to provide support or handle any claims relating to the App.
You must be at least 13 years old to use the App. By using the App you represent that you meet this requirement. If you are under 18, you confirm that you have obtained parental or guardian consent. We reserve the right to terminate accounts of users who misrepresent their age.
Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to download and use the App on Apple-branded devices that you own or control, solely for your personal, non-commercial purposes as permitted by the App Store Terms of Service.
You may not: (a) copy, modify, or distribute the App; (b) reverse engineer, decompile, or disassemble it; (c) sublicense or sell access to it; (d) use it to build a competing product or service; or (e) remove any proprietary notices.
PhotoAI offers auto-renewable subscriptions and one-time credit packs purchased through Apple's in-app purchase system. All payments are processed by Apple — we never receive or store your payment card details.
Exact prices in your currency are shown in the App before you confirm a purchase.
Subscriptions automatically renew at the end of each billing period at the same price unless you cancel at least 24 hours before the renewal date. Your Apple ID account will be charged within 24 hours prior to the end of the current period.
If a free trial is offered, any unused portion is forfeited when you purchase a subscription during the trial period.
You can manage or cancel your subscription at any time through your Apple ID account settings:
Settings → [Your Name] → Subscriptions on your iOS device, or via the App Store on Mac. Cancellation takes effect at the end of the current billing period — you retain access until then. Deleting the App does not cancel a subscription.
All purchases are processed by Apple. Refund requests must be submitted to Apple directly at reportaproblem.apple.com. We are unable to issue refunds directly. Credits from one-time packs are non-refundable once consumed.
Credits purchased as one-time packs do not expire. Subscription credits are allocated each billing cycle and any unused credits from the previous cycle do not roll over when the subscription renews.
You retain full ownership of photos you upload. By submitting a photo you grant us a limited, temporary license to process it solely for the purpose of generating the AI effect you requested. We do not claim ownership of your images and will not use them for any purpose other than delivering the requested output.
You are solely responsible for ensuring that you have the rights to upload any image. You must not upload images that:

Violation of these rules may result in immediate suspension or termination of your account without refund.
The App, including its design, code, trademarks, and all AI-generated outputs produced by our platform (excluding your original uploaded content), are owned by or licensed to Vadoo Internet Services Private Limited. Nothing in these Terms transfers any intellectual property rights to you beyond the limited license described above.
The App uses third-party AI model providers (such as Replicate, fal.ai, and others) to generate effects. Your images are forwarded to these providers solely for inference. We are not responsible for the acts or omissions of third-party providers.
The App is available through Apple's App Store. Your use is also subject to Apple's Standard EULA and the App Store Terms of Service. In the event of any conflict between these Terms and Apple's terms, Apple's terms govern with respect to App Store matters.
THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTY OF ANY KIND. TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, VADOO INTERNET SERVICES PRIVATE LIMITED AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATING TO YOUR USE OF THE APP, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL LIABILITY TO YOU FOR ANY CLAIM SHALL NOT EXCEED THE AMOUNT YOU PAID TO US IN THE 12 MONTHS PRECEDING THE CLAIM.
Apple has no liability whatsoever with respect to the App or these Terms.
You agree to indemnify and hold harmless Vadoo Internet Services Private Limited and its affiliates from any claims, damages, losses, and expenses (including reasonable legal fees) arising out of your use of the App, your violation of these Terms, or your violation of any third-party rights.
We may suspend or terminate your access to the App at any time, with or without cause, and with or without notice. Upon termination, all licenses granted to you cease immediately. Provisions that by their nature should survive termination (including limitations of liability, disclaimers, and indemnification) will survive.
These Terms are governed by the laws of India. Any dispute arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts located in Hyderabad, Telangana, India. If you are a consumer resident in the EU or UK, you may also have the right to bring proceedings in your local courts.
We may revise these Terms at any time. Material changes will be communicated by updating the "Last updated" date and, where appropriate, by in-app notification. Continued use of the App after changes are posted constitutes acceptance of the revised Terms.
